1. General Information

Germany exists of the Bundesrepublik and its 16 Bundesländer (Federal states). Every country has its own Capital, Government and Legislation. There are three State-cities: Berlin, Hamburg and Bremen. So, Berlin is a Federal State and the Capital of the Federal State Berlin, as well as Capital of the Bundesrepublik. The parliament has its seat in the Reichstag building, which has been completely remodeled. Berlin became, after the unification the centre of political decision-making and news in Germany and is located in the middle of the surrounding Bundesland Brandenburg.

On August 13th, 1961, the DDR-regime started to construct the famous Berlin Wall, showing the world the historic difference between East and West. In October 1990, Germany - which had been divided in 1945 among the victors of World War II - was reunited as one country. East Germany's communist government fell in 1989, an event that profoundly altered relations between the two Germanys. East Germany dissolved, becoming the Federal Republic of Germany and reunification occurred after the communist system disintegrated in Eastern Europe in the late '80s.

3. Legislation

3.1. Legislation

The 'Gesetz über die Deutsche 4 Klassenlotterie Berlin und die Stiftung Deutsche Klassenlotterie Berlin (DKLB­Gesetz), Law on the German Class Lottery Berlin and the Foundation German Class Lottery Berlin (DKLB-Law), is from June 7th, 1974 (GVBl. S. 1338) and latest changed by Law dated May 3rd, 1996). (GVBl. S.179).

The Deutsche Klassenlotterie Berlin (DKLB) is a public company with its seat in Berlin. Its mandate is the execution of the by the state granted Games of Chances, including Lotteries, Sporttoto and lottery draws, as well as all other related businesses.

The Executive Board (Vorstand) exists of minimal 2 members and is appointed by the Controling Board (Verwaltungsrat). The Verwaltungsrat exists of 6 Senate members and 3 representatives of the personal.

The Controling Board is established for the period the representatives are elected for the Parliament.

The DKLB has the obligation to remit 20% of the turnover as well as the profit on the balance to the "Stiftung Deutsche Klassen­lotterie Berlin" ("DKLB-Stiftung"), the Foundation German Classlottery Berlin'.

The close or the mediation of gaming agreements for a lottery not allowed in Berlin, should be permitted by the Senate or the appropriate authorities. When those rules are not observed one may end up a year in jail or get a serious fine, according to § 286 StGB (Penal Code). Without a permit it is forbidden:

The decree on the permit for public lotteries and drawings dated from 1937 (RGBI. I S. 283) are not applicable for the operations of the DKLB.

The Seat of the Public Foundation 'Stiftung Deutsche Klassenlotterie Berlin (DKLB­Stiftung)' is established in Berlin as well and the Foundation took up office the same day as the law came into force.

The Foundation manages and distributes money to good causes, such as Social, Cultural and Charity institutions, environment projects, sports activities, etc. Every quarter the Foundation has to publish its remittance to good causes. Claims are not allowed to make. Natural persons are not considers as good causes.

4.1 Deutsche Klassenlotterie Berlin

4.1.1 History

4.1.2 General

The 'Deutsche Klassenlotterie Berlin' (DKLB), German ClassLottery Berlin, is Berlin's Lotto company. By Law on the German ClassLottery and the Foundation German ClassLottery (DKLB-Law) she has taken the responsibility, commissioned by the Landes Berlin, to operate Games of Chance and Lotteries in Berlin.

In 2002 the DKLB had a staff of around 180, who dealt with arranging 50 million tickets, via its 1,160 LOTTO-selling points. Weekly, Pro Capita the people in Berlin spent nearly 1.96 EUR on lottery products.

The DKLB is member of the German Lotto­ and Totoblock. This cooperation of the Lotto companies, together with the other 15 Bundesländer, guarantees, that Lotteries and Sportsbetting in whole Germany have the same rules.

The Superzahl, Supernumber, is the last number of the lotteryticket. Is only valid with 6 correct. When a player has 3, 4 or 5 correct, the ExtraNumber (Zusatzzahl) will give the player a higher payout.

4.1.3.2 ODDSET.

An ODDSET bettor may select from 90 different sports events, like Football, Formula 1, Handball, Basketball or Ice hockey meetings. The minimal lay-in is 2.50 for one 'combi-tip'. On the electronic pay slip system the following lay-ins are mentioned following the Pull-Down-Menu: 2.50 EUR, 5.00 EUR, 10 EUR, 15.00 EUR, 20.00 EUR, 30.00 EUR, 50.00 EUR, 100.00 EUR, 250.00 EUR and 500.00 EUR. Handicap-Wette

Handicap-Wette (Betting). The favorite will get a handicap in the form of an imaginary arrears. For the Tipper this means the following formula: Result of the handicap betting = the real Result + the handicap.

Example: The German National Football team wins with 5-0. The handicap result is 5 -4 for the German Team that means that the winning tip is 1. When the match ends 3-0 for the German team. The 4 'virtual' goals Liechtenstein has won. The handicap result is 3-4, so the winning Tip is the 2.

The players win when their tips are correct. The winning is as follows: multiply the layin with the quote of the played game. When, for instance, the lay-in was 20.00 Euro on three betting possibilities with the quotes 1.25/2.5/6.5, than the combination 20.00 (lay-in) x 1.25 x 2.5 x 6.5 = 406.25 Euro.

4.1.3.3 Football-TOTO

The Football TOTO has two different versions:

Spiel 77 can only be played in relation with LOTTO, TOTO and the GlücksSpirale (Lucky Spiral). The only thing the player has to do is to cross the word 'JA' (yes) on the (electronic) betting slip and you are participating in Spiel 77. Determinant is the concordance of the last numbers of the betting slip with the drawn Spiel 77 number.

The Jackpot

Besides the fixed winning quotes there is the possibility with Spiel 77, just like with Lotto, to win the Jackpot. Also with Spiel 77, when there is no player with 7 correct last numbers, the winning sum will be added to the sum to be drawn the next time.

4.1.3.4 SUPER 6

Super 6 can only be played together with Lotto, Toto and GlücksSpirale. The only thing a Super 6-player has to do is marking 'JA' on electronic betting slip.

The first number of the ticket falls out, is not participating in this Extra Lottery (Zusatzlotterie). The last numbers of the ticket with the drawn Super-6 number has to be in the correct following order. More correct digits, means a higher prize. All numbers can be chosen freely. Already with one correct last number, the player receives the doubling of the lay-in.

Lay-in
The lay-in of SUPER 6 is 1.25 EUR per ticket per draw. The total sum is limited to 2,300 EUR per week, by the Lotto company. However, once a player wants, within the limits, he can fix the highest lay-in himself.

4.1.3.5 GlücksSpirale

The GlücksSpirale ticket can be obtained via the Internet-Lotto-Gamingsystem. The player can mark to play for 1, 2, 3, 4, 5 or 8 weeks. When the last numbers are correct and the winning numbers are in the correct following number, a prize may be won. Players may choose them self , freely, the number series.

Lay-in
One ticket costs 5 Euro, excluding the costs 0.25 Euro per week. Automatically a player, when he is marking (Extra), can play for a longer period (costs of 0,.25 Euro will then be deducted. The total sum is limited to 2,300 EUR per week, by the Lotto company. However, once a player wants, within the limits, he can fix the highest lay-in himself.

For Tele-Bingo a player needs only a pen and a TV. The winning numbers will be broadcast weekly at 17.30 hours via MDR (local public TV) during the Tele-Bingo-Show.

Tickets may be obtained via the Internet-Lotto-Gamingsystem for the amount off 2.50 Euro, including costs. The total sum is limited to 2,300 EUR per week, by the Lotto company. However, once a player wants, within the limits, he can fix the highest lay-in himself.

The games

One should compare the 75 tumbling, numbered Bingo-balls with the numbers on the Tele-Bingo-ticket-card and mark the correct numbered balls. There are three different games and the drawn balls remain valid.

For the second game for more Bingo balls are drawn, one marks all the drawn numbers on the card. Who after 38 draws completed the cross with 8 fields wins another prize.

For the third game one keeps on drawing, until a player marks all numbers on his Tele-Bingo-ticket. When there are more winners than one, then the winning will be equally divided between the winners.

The Full House-Jackpot

To win the Full House-Jackpot, the first player who has marked all 24 numbers on his card. However the first time (and after the Jackpot had been paid out) not more than 43 numbers have to be drawn. When the Jackpot has not been won, in the following Telebingo show 44 numbers will be drawn. When again not drawn the Jackpot-Stop-number will be 45, etc. etc.

4.1.4 Key Financials in 2001

The year 2001 was for the DKLB another successful year with a growth in turnover of 312.1 million Euro to 3,375.6 million Euro. The Land Berlin received 362.6 million Euro lottery tax and the DKLB­Foundation could add on its bank account the sum of 3,71.4 million Euro, to be spent for good causes, including 31.7 million Euro coming from the Glücks-Spirale.

4.2 Casino

4.2.1 Legislation

The Law "Gesetz über die Zulassung öffentlicher Spielbanken in Berlin (Spielbankengesetz - SpBG)", Law on the admittance of a Public Casino in Berlin, is dated from February 8th, 1999 (GVBl. S. 70) and was altered for the last time by "Art. XII des Gesetzes vom 16. Juli 2001 (GVBl. S. 260)" and came into force on 3 am, January, 1st, 2002.

In the State Berlin only 2 public casinos are allowed. The only one who may hand out a permission is the Ministry of Finance of the State of Berlin. A permission may be issued for a period not longer than 15 years.

The Land Berlin remits quarterly extra payments to the Foundation German ClassLottery Berlin (DKLB-Stiftung). The Foundation supports herewith good causes for Cultural, Communal and Sports activities.

The Casino operators are exempted from all company taxes. Players have to be older than 18 years.

The personnel of the Casino's are not allowed to accept tips. This prohibition can be lifted when tips are used for the management of the Casino or when all personnel is profiting of those tips.
